Property
Legal support for property transactions, investment structures, leases and development in Thailand.
A clear starting point
Our property practice helps clients understand ownership restrictions, complete due diligence and document transactions with confidence.
Buying or leasing property in Thailand requires a clear understanding of the rights being acquired. Land ownership, condominium ownership and leasehold rights follow different rules, particularly for foreign buyers.
Before committing funds, the proposed structure should be checked for legality, the property and seller should be reviewed, and the parties should agree how the transaction will be completed and registered.
Foreign nationals are generally restricted from owning land in Thailand. Eligible foreign buyers may own a qualifying condominium unit, subject to the foreign quota generally limiting foreign-owned units to 49% of the total floor area of all units in the registered condominium.
Under ordinary Civil and Commercial Code rules, a fixed-term lease of immovable property cannot exceed 30 years. A lease exceeding three years must be made in writing and registered to be enforceable beyond three years.
Review should confirm the seller's identity, authority and entitlement to transfer, the original title and Land Office records, boundaries, lawful access, mortgages, servitudes and other restrictions. Existing buildings, permits, intended use and development constraints should also be checked.
