Digital Law

Data Centres, Cloud and AI Infrastructure

Legal support for establishing and expanding data-centre, cloud, GPU-computing and connectivity businesses in Thailand.

The legal position

Different infrastructure services can require different legal treatment

The legal requirements depend on what the business provides and how it operates. Renting computing equipment, supplying managed cloud services and providing network connectivity can raise different issues.

Hosting, colocation, cloud, GPU rental and connectivity should not be assumed to have the same regulatory treatment. SBC Law advises investors, operators and service providers on regulatory approvals, investment structuring, commercial agreements and ongoing compliance.

01

NBTC authorisation depends on the services and network model

Providers should assess whether their activities require authorisation from the National Broadcasting and Telecommunications Commission and should operate within the authorised scope.

02

The corporate structure and promotion route should support the intended activities

Company establishment, ownership arrangements, joint ventures and applicable foreign-business requirements should be considered together. Qualifying data-centre, cloud and advanced-computing projects may be eligible for BOI promotion, subject to project-specific conditions.

03

Property, utilities and technical responsibilities need contractual alignment

Land and lease arrangements, project approvals, utility contracts, power, water, environmental requirements and allocation of responsibility between facility operators and service providers should be coordinated.

04

Customer commitments should reflect the infrastructure actually available

GPU and server rental agreements, cloud service contracts, service levels, capacity reservations and colocation arrangements should align with equipment, connectivity, security, incident response and data-governance responsibilities.

05

Growth and operational change can create additional legal requirements

Changes in services, ownership, infrastructure or customer arrangements should trigger a renewed review of licensing, regulatory filings, contract updates, data protection and cybersecurity duties.
